Foreclosure Help in San Bernardino County
You are not alone. Here is how the process works in San Bernardino County. And here is where to find free, trusted local help.
How the timeline works here
California uses one timeline. San Bernardino County follows it too.
It starts with a Notice of Default. Your lender records this paper. In our county it is recorded at the County Recorder in San Bernardino. That paper starts the clock (Civil Code §2924).
At least three months must pass before a sale can be set (§2924). After that, the lender can post a Notice of Trustee's Sale. It goes up at least 20 days before the auction (§2924f).
You have a right to catch up on what you owe. That right ends five business days before the sale (§2924c).
From the Notice of Default to an auction is at least about 110 days. It is often longer. This is education, not legal advice.
Using your local resources
Start with free, trusted help. Call a HUD-approved housing counselor. Their advice is free. They can talk with your lender for you.
If you want to try to keep the home, that path comes first. Talk to your lender, a HUD-approved counselor, and a lawyer before you sign anything.
You can also check court forms and get free guidance at the Superior Court Self-Help Center. County staff cannot give legal advice. They can explain how the process works.
If selling makes more sense, we can help you look at that. A short sale is one option. It only works if your lender says yes. That is your lender's choice, not a sure thing.
